Private Car Sale
I purchased a car from an ad on Gumtree last week. Took the car for a drive and everything was in working order. Asked particularly about the battery and was told is 100% no problems. Did not sign anything but received the cars papers and did the transfer. Very next morning I got in the car it was as dead as a doornail. I couldn’t even jump start it and discovered that the terminals were too big and in order for a current to run through, 4 nails were pushed into the gap between the terminal and battery. I have called the seller and requested that I will cancel the sale entirely should he not pay me the money for the battery and new terminals. He slammed the phone down in my face. I would really just like to know whether the “7 day cancellation” consumer act clause applies in a case like this and how would I go about putting this in place.
Hi JenniB! Unfortunately the CPA does not apply to private sales. Perhaps http://www.saconsumercomplaints.co.za may be able to assist you!
