Issueing of Court Summons
How do court summons get legally issued in South Africa? The question refers to the recent threat by SANRAL (South African National Roads Agency) to issue summons on outstanding e-toll bills.
Thus, do these court-summons have to be handed over in person and receipt of it acknowledged? Do they get delivered to a physical address only? If yes, would registered mail be compulsory? Or can court summons just be placed in a post box or letter box?
Your legal opinion and advise is much appreciated!
It is drawn up in the plaintiffs attorney’s office and ‘issued’ by the clerk of the court allocating a case number to it. Then it is served on the defendant by the sheriff of the court.
Thank you! Just to clarify, does “served on the defendant by the sheriff of the court” mean, that it has to be handed to the defendant in person and he will have to acknowledge receipt of the summons?
